DEFINITIONS OF TERMS USED

Seller – Prima Safe Development S.R.L., with its registered office at Drumul Creţeştilor, Nr. 19, Bucureşti, Sectorul 4, Romania, Romania, registered with the Trade Register under no. J2014005130404, unique identification code RO33109102, bank accounts no. RO02BTRLRONCRT0DH2003601 opened with Banca Transilvania and no. RO61INGB0000999920625602 opened with ING Bank.

Buyer – any natural person over the age of 16, legal person or any legal entity that creates an account on the website www.prima-shop.ro and places an order. The provisions specific to consumer protection shall apply exclusively to natural persons and not to legal persons.

User – any natural person over the age of 16 or legal person registered on the website who, by creating an account, has accepted the website-specific clauses in the “Terms and Conditions” section.

Account – the section of the website consisting of an e-mail address and a password, which allows the Buyer to submit orders and which contains information about the Buyer and their history on the website (orders, tax invoices, etc.). The User is responsible for ensuring that all information entered when creating the account is correct, complete and up to date.

My Cart – a section of the account that allows the Buyer / User to add the products they wish to purchase, either at the time they are added to the cart or at a later time.

Website – the online store hosted at the web address www.prima-shop.ro.

Order – an electronic document serving as a form of communication between the Seller and the Buyer, by which the Buyer conveys to the Seller, via the Website, their intention to purchase products from the website.

Goods/Products – any product presented on the website, including the products mentioned in the order, to be supplied by the Seller to the Buyer.

Commercial Communications – any type of message sent (e-mail / SMS / phone call, etc.) containing general and thematic information, information about products similar or complementary to those you have purchased, offers or promotions, as well as other commercial communications such as special offers, market research and opinion polls.

Transaction – the collection or refund of an amount resulting from the sale of a product by Prima Safe Development S.R.L. to the Buyer, using the services of the card processor approved by the Seller, regardless of the delivery method.

ONLINE SALES POLICY

By placing an order on the website, the Buyer agrees to the form of communication (e-mail, phone call, etc.) through which the Seller conducts its commercial operations.

For justified reasons, we reserve the right to restrict Users' / Buyers' access to placing orders and / or to certain accepted payment methods, without prior notice, if we consider that, based on their behavior or activity on the website, their actions could in any way harm Prima Safe Development S.R.L. In any of these cases, Users / Buyers may contact us by phone or e-mail to be informed of the reasons that led to the application of the measures described above.

We reserve the right to change prices as a result of exchange rate fluctuations or other circumstances. Once the Seller has confirmed the Buyer's order, prices can no longer be changed.

All information used to describe the products available on the website (texts, images, presentations) does not constitute a contractual obligation on the part of the Seller, being used exclusively for presentation purposes. Due to the screens of electronic devices (PC, Laptop, Tablet, Phone) and their settings, please note that there may be differences in shade between the colors of the products displayed on the website and the products themselves.

The Seller may publish on the website information about products and/or promotions it offers for a certain period of time and while stocks last.

In the case of online payments, the Seller is not / cannot be held responsible for any other additional costs incurred by the Buyer, including but not limited to currency conversion fees charged by the bank that issued the Buyer's card, if the card's currency differs from the original currency. The responsibility for this lies solely with the Buyer.

ORDERS

The Buyer may place orders on the website by adding products to the shopping cart and then completing the order by paying with one of the available payment methods. A product added to the shopping cart is available for purchase as long as it is in stock. Adding a product to the shopping cart without completing the order does not result in the order being registered, nor, implicitly, in the automatic reservation of the product.

By completing the order, the Buyer acknowledges that all data they have provided, necessary for the purchasing process, is correct and complete at the time the order is placed.

The Seller may cancel the order placed by the Buyer, after prior notice to the Buyer, without any further obligation of either party towards the other and without either party being able to claim damages from the other, in the following cases:

• the transaction is not accepted by the bank that issued the Buyer's card, in the case of online payment;
• the transaction is invalidated by the card processor approved by Prima Safe Development S.R.L., in the case of online payment;
• the data provided by the Buyer on the website is incomplete and / or incorrect;

If a product ordered by the Buyer cannot be delivered by the Seller, the Seller will inform the Buyer of this and will refund the value of the product to the Buyer's account within a maximum of 7 days from the date on which the Seller was informed and became aware of this.

The availability of a product will be displayed on the Website as follows:

• “in stock” – there is sufficient stock for delivery.
• “limited stock” – there is stock, but it may run out.
• “on order” – the product is made or brought in to order. When you place the order, you will be informed how long it will take to receive the delivery. You will be contacted by a sales agent.

REVIEWS, COMMENTS, QUESTIONS AND ANSWERS

Users / Buyers may write Reviews, Comments, Questions and Answers in the “Customer questions and answers” and “Reviews” sections.

When adding a Review / Comment / Question / Answer on the Seller's website, each User / Buyer undertakes to comply with the following rules:

• to refer only to the characteristics and / or use of a particular product, avoiding information on aspects that may change (price or promotional offers) or information about how the order was handled;
• to use appropriate language, without terms that may offend or affect the Seller or another User / Buyer;
• to make sure the content entered on the Website is correctly placed, as follows: any Question will be posted in the “Customer questions and answers” section, and any Review will be posted in the “Reviews” section;
• to make sure the information they enter is realistic, correct and in accordance with applicable laws, thus also respecting the rights of other parties, copyrights, trademarks or other property, publicity or privacy rights;
• to use this feature only to communicate or obtain additional details about a particular product on the website, without referring to other companies promoting the sale of similar items;
• not to provide or request, in any way and to any extent, personal data (contact details, information about delivery or home address, phone numbers, e-mail addresses, first and / or last names, etc.) or any other information that could lead to the disclosure of such personal data;
• not to post information and / or details from other commercial websites carrying out the same commercial activity as the Seller;
• not to attempt to defraud the services provided by the Seller or to post Reviews / Comments / Questions / Answers containing advertising material;
• not to use the Review / Comment / Question / Answer as a means of communicating with the Seller; for this purpose, the Seller's contact details listed on the Website shall be used.

When a Review / Comment / Question or Answer is reported by a User / Buyer as having inappropriate content, that content will be checked by the Seller to determine whether it violates the Terms and Conditions of the website.

If the Seller finds repeated violations of the Terms and Conditions, it reserves the right to suspend the User's / Buyer's ability to post Reviews / Comments / Questions or Answers in the “Customer questions and answers” and “Reviews” sections.

COPYRIGHT

The entire content of the Website – images, photographs, texts, symbols, web graphic elements, scripts, software and other data – is the property of the Seller and is protected by copyright law and by intellectual and industrial property laws.

The Buyer / User is prohibited from using, copying, distributing, publishing, transferring to third parties, modifying, or including any content in any context other than that originally intended by Prima Safe Development S.R.L., including any content outside the website, removing the marks signifying the copyright of Prima Safe Development S.R.L., as well as participating in the transfer or distribution of materials created by reproducing, modifying or displaying the content, except with the written consent of Prima Safe Development S.R.L. Undertaking the actions mentioned above is punishable under the legislation in force.

INVOICING, PAYMENT AND DELIVERY POLICY

Invoicing and Payment for Goods

The prices of the goods displayed on the website www.prima-shop.ro do not include VAT (21%)

Prices do not include delivery costs, except where this is specified on the product page, at checkout or, as the case may be, within various limited-time campaigns organized by the Seller.

The price, payment method and payment term are specified in each order.

The Seller will issue the Buyer an invoice for the delivered Goods, and the Buyer is obliged to provide all the information necessary to issue the invoice in accordance with the legislation in force.

For the invoice related to the order to be communicated correctly, the Buyer is obliged to update the data in their account whenever necessary and to access the information and documents related to each Order available in the Account.

By submitting the Order, the Buyer agrees to receive invoices in electronic format, either added by Prima Safe Development S.R.L. to their Account or by e-mail, at the e-mail address stated in their Account.

The accepted payment methods are:

Bank payment in advance (bank transfer, payment order):
The payment details will be sent to you by e-mail, in the order confirmation e-mail or as a proforma invoice.

These details include:
- Our company details, as the payment beneficiary
- The amount due (order total)

With this information, you can make the payment either via Internet Banking or at your bank's counters.

In this case, delivery can be made after the payment is confirmed, a process that takes between 12 and 24 hours from the date the payment order is issued.

Cash on Delivery
You will pay in cash, upon receipt of the ordered products, directly to the courier company's agent, who will issue you the corresponding receipt, up to a limit of 5000 lei.

Online card payment
No fees are charged for card payments (nor for the other payment methods)

You can use debit or credit bank cards.

Card payment processing is secured to the highest security standards. We do not have access to and do not store your card details.

Visa and MasterCard bank cards (Visa/Visa Electron and MasterCard/ Maestro) are processed using the 3-D Secure system. This system ensures, first of all, that no information related to your card is transferred or stored, at any time, on the store's servers or on the payment processor's servers, as this data is entered directly into the Visa and MasterCard systems.

The payment processor is Banca Transilvania (BT iPay). Visa, Mastercard and Maestro debit or credit cards are accepted; payment is made in lei (RON), with no additional fees.

Payment link
After the order is received and this payment method is chosen, you will be contacted by a sales agent to validate and confirm the order, after which a link for paying the order amount by card will be sent to the e-mail address indicated by the customer

For online payments using bank cards, the security and validity of card authentication will be confirmed by the electronic payment processor. Transactions are carried out exclusively through the online processor's IT systems, under conditions of maximum security. No information related to the Buyer's card will be stored on the Seller's servers.

DELIVERY OF GOODS

The Seller will ensure the appropriate packaging of the goods and the sending of the accompanying documents. The final price paid by the Buyer consists of the product price and shipping costs. This price will be displayed on the final order confirmation page.

The Seller undertakes to ship the products included in the accepted order to the Buyer by courier, to a delivery address within Romania, observing the delivery dates and terms established when the order was accepted.

Ownership of the goods will be transferred upon their delivery to the indicated address (by signing for receipt of the transport document provided by the courier or signing for receipt of the tax invoice in the case of deliveries made directly by the Seller) and upon full payment.

Delivery costs
Shipping is free for orders over 500 lei (product value, VAT included) with a total weight of no more than 9 kg.

For orders under 500 lei or heavier than 9 kg, the delivery cost is the Sameday rate for the delivery address and parcel weight. The exact cost is shown in the cart and at checkout, before the order is submitted.

Delivery methods
Delivery is made via Sameday or by our own couriers, depending on availability and the recipient's location, with an estimated delivery time of 1 to 3 business days.

The order can also be picked up in person from an easybox or a Sameday Point selected at checkout; the pickup code is sent by Sameday by phone and e-mail.

Delivery can also be made by another courier company agreed by the Buyer. In this case, you must place the order with the agreed carrier; the pickup request is not made by Prima Shop staff.

Delivery time
Delivery time ranges from 1 to 3 business days from receipt of the order, depending on the product ordered.

The delivery time is stated on each product page.

If an order contains products with different delivery times, the delivery time will be that of the product with the longest delivery time.

No deliveries are made on Saturdays, Sundays or public holidays.

Delivery destinations
Products are shipped only within Romania.

FORCE MAJEURE

Neither party shall be liable for non-performance of its contractual obligations if such failure to perform on time and/or properly, in whole or in part, is due to a force majeure event.

Force majeure is an unforeseeable event, beyond the control of the parties, which cannot be avoided.

If the event does not cease within 15 (fifteen) days from the date of its occurrence, each party shall have the right to notify the other party of the termination of the contract by operation of law, without either party being able to claim damages from the other.

DISPUTES

Any conflict arising between the Buyer and the Seller will be settled amicably by agreement between the two parties. If this is not possible, jurisdiction lies with the Romanian courts.

WARRANTIES, COMPLAINTS AND RETURN POLICY

Prima Safe Development S.R.L. ensures and guarantees the conformity of the purchased products as well as against any hidden defects, declaring on its own responsibility that the products sold do not endanger life, health or occupational safety and do not have a negative impact on the environment.

Products purchased through the website benefit from their specific warranty period, stated on the website, on the product page. The product will be accompanied by a warranty certificate.

Complaints

Before use, please check all purchased products and carefully read the instructions for use of each product.

Check the purchased products for any visible defects.

Complaints received after the product has been used will not be considered.

If the purchased products have manufacturing defects, return them together with their original packaging.

Products with manufacturing defects confirmed by the Seller will be replaced, or the Buyer will be refunded for the defective products.

Before use, carefully read the product labels (with instructions for use) and keep them in case of a complaint, and also so you know how to clean and maintain the product in the future.

Return policy

Purchased products may be returned in accordance with Government Ordinance (O.G.) 130/2000. They may be returned, in their original packaging and in the same condition in which they were received, within 14 days of receipt, without penalties and without giving any reason.

Products are returned exclusively at the Customer's expense, and all benefits received with the purchase (shipping costs, promotional products, discounts granted, etc.) will be withheld, except in cases where the goods were sent in error or are defective through the Supplier's fault.

The value of the returned products will be paid within a maximum of 14 days from their return, by bank transfer.

Product Return Conditions

The goods are complete, clean, in intact original packaging (without traces of dirt, tape, punctures, tears or scratches) and have not expired in the meantime.

The following are exempt from the right of return: products made to order, according to the Buyer's specifications and instructions or personalized for the Buyer, products that can deteriorate or degrade quickly, and products that are part of a set and cannot be separated from the other components.

48 hours after receipt, a product is subject to Service or Warranty conditions and can no longer be returned, only repaired or replaced.

Conditions for Return to Service:

To benefit from the warranty, presentation of the invoice and the Warranty Certificate is mandatory. The product must be accompanied by all the accessories with which it was purchased and delivered.

The product subject to the complaint must bear all the identification elements stated on the purchase document, on the label or packaging, or marked directly on it (lot/ serial number, etc.).

If products are sent for service, it is recommended (but not mandatory) to send them in the original packaging; they must not show signs of breakage or impact.

For products whose parcels show visible damage on receipt, it is recommended to inspect them in the presence of the carrier or to refuse the parcel.

The parcel must be photographed and a report must be drawn up stating the condition of the parcel at the time of delivery.

If a carrier appointed by the consumer is used, the risk is transferred when the products are handed over to the carrier.

Returns are NOT accepted for orders placed by legal entities.

The product warranty does not cover the following situations:

• Defects caused by improper use
• Thermal, mechanical and plastic damage to the product caused by accidents, vibrations, bad weather, negligent use or other factors beyond the Manufacturer's control
• Use of the product in unsuitable conditions (e.g. inappropriate supply voltage, action of chemicals, noxious fumes, smoke, dust or humidity, etc.)
• Use of the product in applications requiring performance and qualities other than those offered by the class and purpose for which the product is intended, or outside its technical specifications
• Failure to follow the instructions for use or installation provided in the product manual
• Use of batteries, power supplies or accessories other than those produced, approved or recommended by the Manufacturer
• Alteration of the product's original condition through unauthorized intervention
• Loss of or damage to the warranty certificate

The warranty period is automatically extended by the time the product is held by the Supplier for justified and approved service procedures.

When returning the product, you must fill in the RETURN FORM, then send the returned goods using the same courier with which they were shipped.

FINAL PROVISIONS

The Seller reserves the right to make any changes to these provisions, as well as any changes to the Website, its structure or any other changes that may affect the Website, without prior notice to the User or Buyer.

The images shown on the Website are for presentation purposes. We strive to ensure that both product images and the information we provide are clear and accurate. Nevertheless, certain errors may occur. Also, product colors may differ in reality from the photographs on the website due to the User's or Buyer's monitor settings.

The Seller cannot be held responsible for any errors appearing on the Website for any reason, including changes or settings not made by the Website administrator.

The Seller cannot be held responsible for damages of any kind that the Buyer or any third party may suffer as a result of the Seller's performance of any of its obligations under the Order, nor for damages resulting from the use of the Goods and Services after delivery, and in particular for their loss.

By creating and using the Account, the User / Buyer assumes responsibility for maintaining the confidentiality of the Account data (username and password) and for managing access to the Account and, to the extent permitted by the legislation in force, is responsible for the activity carried out through their Account.

By creating the Account and / or using the Content and / or placing Orders, the User / Buyer expressly and unconditionally accepts the Terms and Conditions of the Website in the latest updated version published on the Website, in force at the date of creating the Account and / or using the content and / or at the date of placing the Order.

The Seller processes personal data for the purpose of informing Users / Buyers by e-mail about the orders placed, for advertising, marketing and publicity, and for electronic communications services, in accordance with Law no. 677/2001. You also agree that the Seller may freely use, in its own interest, the information, ideas, concepts or techniques you have sent us through the Website. Prima Safe Development S.r.l. shall not be subject to any obligations regarding the confidentiality of the information sent, unless the legislation in force provides otherwise.

The Seller may notify users of current offers through online newsletters and may send discount vouchers or other special messages.
